DUI Consequences in Kansas

If you are charged with DUI in Kansas, 2 separate lawsuits are filed against you simultaneously:

  1. A Criminal Case (State of Kansas/City v. You)
  2. A Civil Case (Department of Revenue v. You)

These two proceedings are distinctly different - different judges, prosecutors, court, burdens of proof, and most importantly, different consequences.

Kansas DUI consequences:

CRIMINAL CASES

1st DUI (Class B misdemeanor):

Freedom: minimum of 48 hours in custody; up to 6 months in jail; loss of license
Money: $500-$1000 fine
Probation: only after 48 hours imprisonment/100 hours community service

2nd DUI (lifetime) (Class A misdemeanor):

Freedom: minimum of 5 days in custody; up to 1 year in jail; loss of license
Money: $1000-$1500 fine
Probation: only after 5 days consecutive imprisonment; work release or house arrest possible after 48 consecutive hours jail

3rd DUI(lifetime) (ungraded felony):

Freedom: minimum 90 days in custody; up to 1 year prison; loss of license
Money: $1500-$2500
Probation: only after 90 days imprisonment; work release/house arrest possible after 48 consecutive hours jail

4th DUI (lifetime) (ungraded felony):

Freedom: minimum 90 days; up to 1 year in prison and postrelease supervision; driver's license
Money: $2500 fine
Probation: only after 90 days imprisonment; work release possible after 72 consecutive hours jail

CIVIL CASES (ADMINISTRATIVE HEARING)

Must be requested within 10 days of service of Form DC-27 (pink sheet) or driver waives hearing and suspended automatically.

If you lose your administrative hearing and are suspended:

Under 21 driver:

Penalties apply for .02-.08: 30 days suspension, followed by 330 days of restricted privilege
For breath test .08: 1 year suspension
For breath test refusal: 1 year suspension

1st DUI Occurrence:

Failed breath test: 30 days followed by 330 days of restricted privilege
Refused breath test: 1 year

2nd DUI Occurrence (lifetime):

Failed breath test: 1 year + 1 year interlock ignition
Refused breath test: 2 years

3rd DUI Occurrence (lifetime):

Failed breath test: 1 year + 1 year interlock ignition
Refused breath test: 3 year suspension

4th DUI Occurrence (lifetime):

Failed breath test: 1 year + 1 year interlock ignition
Refused breath test: 10 year suspension

5th or subsequent DUI Occurrence (lifetime):

Failed breath test: Permanent revocation
Refused breath test: Permanent revocation
